Lost deposit on a car

I paid a €300 cash deposit to a garage for the agreed purchase of an Alfa Romeo 147. Ten days later I phoned them to schedule picking up the vehicle for later that day, only to be informed that they had sold the car to another purchaser that weekend.

This was done after my having alerted them on numerous occasions in the intervening period that for personal reasons I was forced to postpone the pick-up of the car, to which I received no response from the company.

How acceptable therefore is the practice of selling a car to a third party when a deposit has already been paid? At no time did they indicate to me that this may happen. Furthermore, when I asked for them to return the deposit to me, they flatly refused and hung up the phone on me.

How many other buyers have been tricked in the same way by this company? How many other companies are operating similar practices?
